APPROVED PROJECTS CATALOGUE CALL FOR PROJECTS 05 and 06 of 2021 FUNDO OSC/ MROSC PLATFORM INTRODUCTION M ROSC Platform, aiming to strengthen the Civilian Entities and the favorable environment for their performance, launched two development call for projects in 2021. The perspective is to contribute to the advance of the federative implementation of the broad agenda of the Regulatory Framework of Civil Society Organizations (CSO) and to promote the citizen participation of the organizations in the sustainable development chain. As a result, the amount of R$396,000.00 was allocated to the projects approved in the Call for Projects 05 and 06, promoting national actions divided into two axes: i. Sustainability; e, ii. Studies on the Bureaucratic Criminalization of CSOs. The proposal of Axis I, called Sustainability, is to contribute to strengthening the institutional capacity of CSOs, especially the small ones, to act and influence the improvement of the legal, political and institutional environment. Regarding Axis 2, Studies on the Bureaucratic Criminalization of CSOs, the goal is to support CSOs that develop research independently or in partnership with studies and research centers (from universities or civilian entities) to develop actions/research on the bureaucratic criminalization of CSOs. The Call for Projects 05.2021, was an invitation to signatory entities and CSOs that are not yet part of the MROSC Platform to present projects with actions up to R$18,000.00 each. In total, 39 proposals have been received and 12 actions were considered. Call for Projects 06.2021, on the other hand, was aimed at providing exclusive support to the State MROSC Platforms, with actions of up to R$20,000.00 each, 9 of which were contemplated, as a way to support the consolidation and structuring of these network. Thus, 21 projects have been selected in total, from the 5 regions of Brazil, 14 projects for Axis 1 and 7 for Axis 2, in the following states: Acre, Bahia, Ceará, Federal District, Minas Gerais, Pernambuco, Rio de Janeiro, Rio Grande do Sul, Santa Catarina, São Paulo, and Sergipe. All actions are scheduled to be executed between November 2021 and September 2022. It should also be noted that the selected projects are inserted in the macro areas of education, social assistance, human rights, sports, culture, environment, and promotion of equality. This diversity of segments creates a multiplier effect that goes beyond the nominal economic value of the budgets presented that manage their possible results. Therefore, they meet the five cornerstones of the MROSC Platform and the Sustainable Development Goals (SDGs). As a rule, the indication of the SDGs in the projects stimulates the achievement of goals in order to transform society towards sustainability and so that we can achieve the proposals of the UN’s 2030 Agenda in Brazil. This catalogue is organized according to the two axes and the regions, and includes a compilation with the description of the supported actions, the main activities, the project’s name, the CSOs involved in its implementation, the indication of the SDGs to be achieved, the resources allocated to each project, and the territorial coverage of the actions. The granted support integrates the initiative “Strengthening and Regionalization of the MROSC Platform”, executed by Caritas Brazil and ELO Ligação e Organização, and supported by the Delegation of the European Union to Brazil, which aims at strengthening the territorial bases of the Platform, the implementation of MROSC’s federative agenda and the improvement of the legal, political and institutional environment for the CSOs to operate. Description: The State of Minas Gerais is the second largest Brazilian state in number of registered CSOs and has a strong history in Brazilian politics. In this context, the project’s main scope is to reinforce the CSOs and their legal, political, and institutional environment through movements that mean the implementation, the rooting, and the expansion of the State Platform and of an agenda that entails active articulations in the Minas Gerais territory. For such, the target audience are the signatory and non-signatory CSOs, considering the need to bring more organizations to the debate about the regulatory and institutional environment of CSOs in Brazil, in a plural and qualitative way. It is important that these CSOs understand well the role and potentialities of the State Platform and how this collective can provide a better environment for action and sustainable and integrated development; besides training themselves as leaders capable of managing this movement with the necessary democratic turnover and plurality. Therefore, the project foresees the execution of research and diagnostics to identify, get to know and mobilize CSOs, promoting articulation and interchange among existing experiences and practices, by means of workshops, training and capacity building, which will prepare the ground for a seminar from which the main concrete articulations will come out to make effective the Minas Gerais Platform based on the MROSC Platform’s Letter of Principles. Location: National coverage. Total value: R$18,000.00 MANAGING CSO: UCB – União de Ciclistas do Brasil 2 Santa Catarina Rio Grande do Sul 16 GO BACK TO THE MAP Description: The project ‘Expanding the MROSC in the Brazilian cyclo-activism’ intends, over a period of 10 months, to articulate local associations active in the cyclo-activism area to the benefits provided by the MROSC. The work, divided into 6 stages, will be carried out by the Observatório da Bicicleta, linked to the União de Ciclistas do Brasil. UCB, as a nation-wide institution, positions itself as a partner of the MROSC and sees in this project the opportunity to represent an entire segment of activism and work with the MROSC. As a renowned representative of a number of institutions, UCB intends to use its structure, expertise, and visibility to articulate agents of cycle mobility from all over the country, seeking to overcome a small gap that this category of institutions presents: the disarticulation in relation to what the MROSC can offer. From this project, it is expected to produce new materials that will contribute to mapping the MROSC’s engagement with cyclo-activist institutions. The project has a series of deliverables that will ensure transparency and tangibility to the results of the work. Thus, this project acts on a small gap in the articulation between the MROSC and mobility-oriented institutions. And, because of this, one of UCB’s jobs and missions is to identify potential points of contact, as yet unexplored, and guarantee them tangibility and articulation. The project will have a national scope, that is, it will reach all regions of the Brazilian territory. REGIONAL SEMINAR ON THE SUSTAINABILITY OF OSC AND THE LAW No. 13.019/14 State: Rio Grande do Sul. Location: Municipality of Rio Grande Total value: R$18,000.00 MANAGING CSO: Instituto Cultural Filhos de Aruanda Description: With the advent of Law 13.019/2014, the Terms of Development and Collaboration emerged, instruments for entering into partnerships between the government and CSOs, replacing the former Agreements. This new regulation has impacted the relations between public authorities and CSOs all over the country. Its implementation stimulated democratic public management in all the different spheres, and began to value Civilian Entities. Supported by clear rules that are valid throughout the country, with a focus on transparency, social participation in decision making, quality of public spending, and control of results, CSOs can expand their capacity to act and intensify the incorporation of their agendas to the public agenda. However after 5 years of its implementation in the municipalities (2017), many entities, associations that qualify as CSOs, do not know this instrument and are still confused by the terminology and the new rules established. In light of the aforementioned, the project will address, through lectures, workshops, and conversations, the importance of the formalization of collectives and CSOs, the difference between nomenclatures, the presentation of the MROSC Platform, Law No. 13.019/14, and guidelines on the development of social projects 17 1 Tap the desired region to go to the corresponding block Northeast Ceará 5 Southeast 1 7 Projects São Paulo Minas Gerais Rio de Janeiro South AXIS 2 Santa Catarina STUDIES ON THE BUREAUCRATIC CRIMINALIZATION OF THE CSOs Northeast ASSOCIATION-BASED CANNABIS REGULATION MODEL – CASE STUDY FROM NORTHEASTERN BRAZIL 1 Ceará 19 GO BACK TO THE MAP State: Ceará Location: Northeast Region Total value: R$18,000.00 MANAGING CSO: Associação Florar Description: The project proposes to draft an article on cannabis associations in Brazil, with research on jurisprudence in the superior courts and focus on at least three case studies, of associations in the states of Bahia, Paraíba, and Rio Grande do Norte. The project will also seek to involve collectives and other groups, such as Coalizão Negra. Description: As of 2022, Abong seeks to prepare an annual report by its Legal WG, with the bureaucratic criminalization of CSOs as one of the central themes. Thus, the project proposes to consolidate part of this report, contributing to a global analysis on rights violations of CSOs and activists. The project involves producing a survey and listening to Abong’s member CSOs regarding situations of bureaucratic criminalization they have experienced. The first step is the analysis of the CSOs associated with Abong in the five regions of the country for selection based on operational axes and/or situations of bureaucratic criminalization already identified in the legal assistance or initial interview. One of the goals is also to focus on CSOs working in defense of the rights and protection of women and the black population, in a transversal way. After the initial selection, interviews will be conducted to deepen the mapping of the concrete cases, identifying what happened with the CSO; what was done as resistance; the outcome of the situation of rights violation; among others. The concrete cases will be analyzed based on their general themes, also identifying the position of the Judicial Power and administrative bodies on the issues analyzed. All the research will be systematized in a report that can present the data, analysis, and articulations of the CSOs as a response to the bureaucratic criminalization, and considerations about the challenges of the next period. The report will be published and disclosed in the national territory and also in the international spaces in which Abong is involved. The research will examine the different formats, functions, character, operation and legitimacy of the councils. It will present successful examples for analysis and address the current situation of the councils linked to the Department of Culture of the city of São Paulo. The survey will provide for a more qualified debate on the relationship between the councils and the MROSC, the SDGs, the National Culture System, and as a space for political activists to participate. The dissemination of the knowledge generated in the survey will be done through the podcast platform Hub da Norte that belongs to Mudança de Cena. This way, the project aims to expand the debate on the theme and pressure the city’s Department of Culture to implement and reactivate the councils foreseen by law. Through podcasts, the action will try to bring culture workers, organizations, networks, forums, and movements closer to the MROSC. The Regulatory Framework is still a novelty for artists, culture makers, managers, and technicians, and it is necessary to understand how it impacts and facilitates partnerships in the sector. 22 Bringing culture workers, organizations, networks, forums, and movements closer to the MROSC SAY NO TO THE BUREAUCRATIC CRIMINALIZATION OF THE CSOs THAT DO NOTHING BUT GOOD! Location: National coverage Total value: R$18,000.00 MANAGING CSO: Instituto Cultural In-Cena Description: Since Law No. 13.019/2014 became effective, establishing the legal framework for partnerships between the public administration and civilian entities, it can be seen how the challenges are continuously present to ensure the effectiveness and efficiency of the norms and rules that it provides. The project proposes to conduct a study on how to apply the rule of Article 11, sole paragraph, item VI of Law No. 13.019/2014, in view of the provisions regarding data protection under Law No. 13.709/2018. The appropriate compatibility of the interpretation and application of the LGPD and the MROSC is essential to provide legal certainty to organizations, since it is a concrete situation and mandatory compliance for civilian entities partnering with the public administration, which, in fact, may represent the creation of another situation for undue bureaucratic criminalization. 24 South PARTICIPATE TO RESIST State: Santa Catarina. Local: State coverage. Total value: R$20,000.00 Responsible Articulation: MROSC Platform in Santa Catarina Managing CSO: Instituto Bem Viver (IBV) CSOs involved in the execution: (1) Fórum de Políticas Públicas de Florianópolis (FPPF); (2) Lar Fabiano de Cristo Casa de Rodolpho Bosco; (3) Instituto Comunitário Grande Florianópolis (ICOM). 1 Santa Catarina 25 GO BACK TO THE MAP Description: The Project’s general objective is to strengthen Civil Society Organizations (CSOs) and the Councils for the Defense of Rights and Public Policies in the City of Florianópolis in the construction of a favorable legal, political, and institutional environment which advances the federative implementation of the MROSC agenda and the full functioning of the Councils. The “Participate to Resist” Project intends to achieve its general objective through three main axes: 1. Institutional strengthening of the FPPF, CSO and Councils; 2. Map the strategies, systems and institutional situations of discrimination and criminalization of civilian entities and activities; 3. Training in Guarantees of Fundamental Rights and anti-discriminatory practices. These axes involve the proposal of describing and systematizing practical cases involving bureaucratic criminalization as a barrier to the development and performance of CSOs, based on the case of the Casa do Povo CSO, in the city of Florianópolis. Based on this and on the data gathering and cases monitored and known to date during the work of the FPPF and the Núcleo de Assistência Jurídica Popular (NAJUP), an empirical research will be carried out with the analysis and systematization of jurisprudence on issues related to the CSOs, indicating possible proposals and interventions for resistance and recovery. Accomplishing this goal, collective activities will be proposed such as training and seminars to disseminate the accumulations and analysis, also offering legal advice and articulations with entities of the Justice system.
